AIBOC CIRCULAR NO. 5 DATED 16TH JANUARY 2010

AIBOC has issued its circular No. 5 on the efforts of the management of Corporation Bank to de-unionise officers. We are reproducing the same here for our readers.

EFFORTS OF THE MANAGEMENT OF CORPORATION BANK TO DE-UNIONISE OFFICERS

        Our affiliate, Corporation Bank Officers’ Organisation has reported that the Management of their Bank has resorted to unfair labour practices such as putting pressure on the Executives in Scale IV and above to resign from the Membership of the Organisation, taking shelter under the instructions given by IBA and the Ministry of Finance, Government of India, dishonouring the bilaterally agreed settlements on transfers, placements, promotions etc.

2.     We have addressed a letter to the Chairman of the Bank requesting him to stop these unfair practices and the letter is annexed to this, which is self – explicit.

EFFORTS ON THE PART OF THE MANAGEMENT TO DE-UNIONISE OFFICERS

        We have been informed by our affiliate, Corporation Bank Officers’ Organisation that, the Management of the Bank has been resorting to bullying tactics to force the Officers in Scale IV and above, to resign from the Membership of the Corporation Bank Officers’ Organisation by taking shelter under the IBA letter dated 25.08.2009 and D.O.letter No. 6/1/20/87-IR dated 24.08.1992 issued by the Ministry of Finance, Government of India.  We are given to understand that due to continuous pressure mounted by the Management, many executives in Scale IV and above have already resigned from the Membership of the organisation.  The pressure tactics adopted by the Management is clearly an unfair labour practice, which is a direct infringement of Article 19(c) of the Constitution and an arbitrary interference in the constitutionally guaranteed fundamental rights of Officers.  The organisation has maintained its cool despite this highly provocative stand taken by the Management.  Their silence should not be treated as a weakness and all officers across the board are standing behind the organisation as one man.

2.     We have already taken up the matter with IBA and Government of India and lodged our strong protest against the arbitrary stand which tantamounts to deunionisation of the Officers’ community in the Banking Industry.  The matter is being pursued vigorously by us and we are prevailing upon the IBA/Government to withdraw the communications issued in a totally unilateral manner.

3.     It is needless to point out here that Corporation Bank Officers’ Organisation has played a crucial and important role in ensuring a concerted growth of the Bank.  The members of the organisation have contributed immensely for the all round development of the Bank.  The Corporate objectives and vision of the Management has been shared by the members of the organisation.  The Officers of the Bank at all cadres have proved that they are the best lot in the Industry, their discipline, fierce commitment and sense of belonging are worthy of emulation.  In this background, it is very disheartening to note that a vicious campaign is launched by the Management functionaries to sully the image of the organisation, by letting loose a reign of terror by flouting the agreed, time tested transfer policy, by resorting to vindictive transfers, favouritism in transfer matters etc.  Attempts were made to terrorise the Officers through vindictive actions and create divisions in the rank and file.

4.     As a responsible and response organisation of officers, the body has always adopted a collaborative and co-operative approach in all matters pertaining to the growth and development of the Bank and by creating divisions amongst the Officers the Management has distanced itself from the disciplined, committed workforce of officers, which will have negative repercussions on the overall development of the Bank.  We hope the Management of the Bank will realise the gravity of the situation and put an end to its efforts to deunionise the officers and allow the officers across the board to carry on with their legitimate Trade Union activities.

5.     We request you to honour all the bilaterally agreed settlements on transfers, placements and promotions, start meaningful and fruitful dialogue with the Organisation for redressal of the grievances of officers in a totally amicable and congenial manner and enable the officers to work without fear or favour with the best interest of the Institution in their hearts.

6.     It may please be remembered that the need of the hour is conciliation not confrontation, genuine concern for each others problems and not regimentation without a human face.

7.     Please arrange to stop all unfair labour practices and initiate steps to usher into an era of peaceful Industrial relationship atmosphere in the Bank which has been the hall mark of Corporation Bank for decades.
