AIBOC CIRCULAR NO. 85 DATED 7TH JUNE 2010 ON REVISION OF GRATUITY CEILING

AIBOC issued its circular No. 85 on revision of Gratuity Ceiling. We are reproducing the same here for our readers.

REVISION OF GRATUITY CEILING - DATE OF EFFECT – DISCRIMINATION TO BANK OFFICERS CONFEDERATION SEEKS INTERVENTION OF THE GOVERNMENT

The amendment to the Payment of Gratuity Act 1972 enhancing the ceiling from Rs.3.5 lacs to Rs.10 lacs was a welcome move. But the date of effect has caused a serious heartburn amongst thousands of officers who have retired with effect from 1.1.2006 since the date of effect has been made as 24th May 2010, an arbitrary decision on the part of the Government. We have to-day sent a communication to the Government reiterating our demand for extending this benefit in Banking Industry with effect from 01.01.2006. A copy of our communication is enclosed.

All our affiliates/members are requested to await further developments in the matter.

BENEFIT OF GRATUITY REVISION TO WORKFORCE IN THE BANKING INDUSTRY

The Banking Industry is considered as an extended arm of the Government machinery both in respect of its functioning and their responsibility towards the Nation. The workforces involved in the administration of the Banking Industry are similar to that of the Government workforce except that they are recruited by the Government. Whereas the workforce in the Banking Industry is recruited by the respective managements of the Banks under the guidance and directions of the Government from time to time.

The service conditions governing the Bank Officers are still much closer to that of the civil servants. The salary and other benefits are no doubt negotiated at the industry level by the Confederation and other organisations but it is ultimately approved and cleared by the Government of India since the Government is the absolute master as far as the Officers’ fraternity in the banking industry is concerned.  It is in this background; whatever the schemes that are brought in the Government in the matter of service conditions are being introduced in the Banking Industry either through negotiations or by persuasion from time to time. The recent classical example is the introduction of the New Pension Scheme as available to the Central Government employees to the Bank employees as well under the 9th Bipartite Settlement plus 2nd option on Pension agreements.

It is in this background, we need to examine the recent developments in regard to the Payment of Gratuity Act. The ceiling of the gratuity was enhanced from Rs.3.5 lacs to Rs.10.00 lacs due to the recommendations of the 6th Pay Commission which is responsible for bringing revolutionary changes in the superannuation scheme including the improvements in the Pension Scheme.  In fact, the Government went one step ahead and decided to grant the enhanced gratuity to their employees with effect from 1.1.2006 since it was the date from which the 6th Pay Commission was implemented.  As the time available was short for obtaining the approval of the Parliament for the enhancement of the Gratuity Ceiling under the Act, the Government by issuing an administrative notification provided the improved Gratuity benefit to their employees all over the country. As a model employer, the Central Government did a right thing which raised the hopes and expectations of all other sections of the workers more so the Public Sector units including the banking industry.  The Reserve Bank of India emulated the example of the Government thereby confirming our faith and belief that the Bank employees are also bound to get a similar treatment from the Government since there is already a precedent in respect of the employees of the Reserve Bank of India.

The Confederation was the first organization to approach to your goodselves and also to the Finance Minister and submitted a Memorandum for taking care of the interest of the employees in the Banking Industry.  We were given a patient hearing and also sympathetic response that the issue will be resolved and the amendment will be moved making sure that the date of effect will be retrospective one. When the amendment got the approval of the Parliament, our hopes were dashed, since there was no mention of date of effect; rather the Law Ministry issued a Gazette Notification saying that the date of effect will be decided by the Central Government.  When we established contact with the departments concerned at the Center, there were again sympathetic attitudes towards our legitimate demand that the employees in the Banking Industry should be treated on par with the Government employees as well as the workforce of Reserve Bank of India and the benefit of the enhanced gratuity should be made effective from 1.l.2006.

However, the Gazette Notification issued from the government came as a bolt from blue. We have been getting anxious enquiries from all parts of the country on date of effect and there is a lot of frustration brewing all over the country.  An individual who retires on 23rd May 2010 or earlier from the date of 1.1.2006 gets a Gratuity of Rs.3.5 lacs whereas the one who retires on or after 24.5.2010 gets a Gratuity of Rs.10 lacs nearly a difference of Rs.6.5 lacs in the superannuation benefit of the workforce in the Banking Industry, which is quite substantial.

We, therefore request you to initiate necessary administrative action to treat officers working in Banking Industry, at par with Government employees, in respect of date of effect of enhanced ceiling on gratuity.

the only solution left now is to proceeds on indefinite stike. because this govt is anti labour as well as procapitalist. the present union in power can help the retired members by proceeding on indefinite strike as early as possible

It is rightly pointed out that all the retirees from 01.01.2006 to 23.05.2010 have been made silent sufferers on account of the govt. blow initiated on the aam admi who have voted them to power. Why should there be two gratuity Acts -one effective from 01.01.2006 for Central Govt. employees and the other from 24.05.2010 for the other employees including PSU's/Banks and other institutions? Are the tax slabs also categorised differently like the way the Gratuity Act has been notified? Please Mr.PM, FM and all the other responsible authorities take a serious view of how tough life has become for an aam admi and extend your helping hand by reviewing the Gratuity Act and making it effective from 01.01.2006for ALL and I am sure you all will receive God's Blessings.

I AM THANKFUL FOR TAKING UP THE ISSUE WITH THE LABOUR MINISTER. WE THE PENSIONER, HAVE, IN FACT, NO VOICE EXCEPT YOU. PL. CONTINUE TO FOLLOW UP WITH THE GOVT./BANK MANAGEMENT SO THAT THE RETIREES PRIOR TO 24.05.2010 DO NOT SUFFER.

The Pensioners in the Banking Industry do not have a platform to express their grievances. The parent banks do not post internal News Letters/magazines/pensions slips, to staff. What a pity?.Now that the pension option is given to all the staff I request Sri.Nadaf, to bring in all the retired officers on one plat form and fight for their cause.Officers who retired between 1.1.2006 to 23.5.2010 have lost more money due to gratuity amendment effective date than what they received by way of arrears of salary due to recent revision.We look forward for your direction.

I substantiate here the need to extend the enhanced limit of 10 lakhs in Gratuity to other sectors as given to Govt Sector for retirees & resignees between 1.1.06 and 24.5.2010.
The self-benefiting law was drafted by Govt Officials and approved by Govt to benefit themselves and their colleagues/constituents, most of whom go scot-free taking bribes. Whatever they are getting as enhanced Gratuity is in addition to what they collect as bribes from Banks and other entities who pay bribes to get their jobs done by Govt Deptts.
Whereas over 50% in PS Banks and Private Sector are honest, more than 50% are corrupt in Govt Deptts and still the Gratuity act is in favour of the Govt employees.
As a Public Sector Bank Branch Manager I used to approach the Distt Level Officials for deposits for my branch.
One official of Zilla Parishad Korba said: Mera Khyal Rakhna.
Another employee of the same Zilla Parishad sent message through another branch manager of my bank to give gifts to him in order to get deposits from Zilla Parishad, Korba.
A Govt official in Nellore Distt of Andhra Pradesh handling Water Shed Funds asked me Rs.10,000/- as bribe for the accounts opened in my rural branch by the beneficiaries (belonging to our branch’s service area) of Water Shed Funds.
An accountant, Mr Gupta, of Municipal Commissioner’s Office Korba asked me Rs.7,000/- for his commissioner Mr Mishra in 2006-07.
The officials(a chief Manager and a zonal manager) of my Public Sector Bank, stationed in Raipur, spoke to me (in Korba) over phone and said the following in the last week of March 2006 in reply to what I said to them : the Govt Officials are asking gifts in return for their Deptt’s deposits for my bank.
The chief manager said : you give gifts.
The zonal manager said: whatever you said to the chief manager, if you do not increase deposits, i will transfer you. This is nothing but a threat conveying consequences if I do not grow deposits whatever be the methods.
Because such systems exist in Govt Deptts and PSUs, a customer of my Public Sector Bank, Mr Dinesh Kedia who runs a printing press in Korba and gets his jobs from Govt Deptts, said in my cabin(branch manager’s cabin of the PS Bank): “Imaandaar aadmi bekar aadmi hain. vo hamaara kamke nahi hain”. He also said on another occasion: even though his relative was a minister in Chhattisgarh State, he was not using the Minister’s influence but uses method of bribing to get Govt business because ministers come and go but they have to do business life long.
Such Govt employees are getting the amended Gratuity benefit from back date whereas the rest of the uncorrupt employees of PSBs and Private Sector have to settle for the Gratuity wef 25.4.10.
When the working in Govt Deptts and my ex-PS Bank is substandard, one cannot expect their planning and thinking any better.
Govt should have some shame and immediately set right the anomaly that is created in the effective date for the Gratuity benefit amendment extended to the Govt employees and the PSBs & Private sector employees.
Hope conscience prevails.

Hyderabad city has the privilege of harbouring eminent bankers like Sri.M.Narasimham, Dr.C.Rangarajan,and Dr.Y.Venugopal Reddy.I honestly feel that Bank Employees Associations can use their good offices,to impress the Govt about the need to extend the enhanced limit of 10 lakhs in Gratuity to bankers as given to Govt Sector retirees between 1.01.2006 and 24.05.2010.

THERE HAS BEEN NO DEVELOPMENT AFTER SH. NADAF LETTER TO THE HON'BLE LABOUR MINISTER IN JUNE 2010. SH. NADAF IS REQUESTED TO INITIATE LEGAL MEASURES AND/OR FURTHER COURSE OF ACTION AS AS ONCE SUGGESTED BY HIM FOR EXTENDING THE GRATUITY BENEFITS TO PENSIONERS RETIRED PRIOR TO 24.5.2010.

Gratuity is paid for those retired prior to 23.05.2010, as per Officers Service Regulations. AIBOC should link increase in Gratuity Ceiling to 9th BPS and request implementation from 1.11.2007 uniformly in Banking Industry so that the retirees prior to 23.5.2010 are also benefited. Bank employees should emulate our Hon M.Ps' in demanding better wages.

As per press, Recently the Govt increased EPF interest rates.
Shri A.D.Nagpal was instrumental for increasing EPF interest to 9.5% for more than 50 million workers. The 77 years old Chandigarh man who is a trade union leader ,a practising socialist and a close associate of Late Shri Jayprakash Narayan, ferreted out the detail that provided the EPF trust with a fiscal cushion. He unearthed the treasure of a disposable surplus of Rs.1731.57 crores and not Rs. 158 crore, as the trust officials believed earlier. This indirectly indicate that employees retired between 1.1.2006 to 23.05.2010 did not get adequate returns on their EPF also. Sh.Nadaf is requested to initiate legal measures for extending gratuity benefit to Pensioners retired prior to 24.05.2010.

The calender year 2010 is coming to an end. The winter sesssion of the Parliament is coming to a close.We donot know the stand/Action taken report, of AIBOC on the issue of, demand extending the benefit of higher Gratuity ceiling in Banking Industry with effect from 01.01.2006, including legal action. In the earlier days AIBOC use to advice its members to release protest telegrams to concerned authorities when the employeees interest is at stake.
Now a days no such action programes were initiated. AIBOC may clarify their current stand on the issue for the benefit of officers retired prior to 24.05.2010.
