AIBOC CIRCULAR NO. 87 DATED 2ND DECEMBER 2009

AIBOC has issued its circular no. 87 on Annual Performance Appraisal Reports of the officers in banks.
We reproduce the same here for our readers.

CIRCULAR NO: 87                    2nd December, 2009  
TO ALL AFFILIATES/MEMBERS: 
MAINTENANCE OF ANNUAL PERFORMANCE APPRAISAL REPORTS SHARING OF THE REPORT WITH THE OFFICER CONCERNED
Our members are aware that the Hon’ble Supreme Court in one of the cases which came up before it recently in regard to the Annual Performance Appraisal Reports; has ruled that the contents has to be shared with the official concerned in tune with the Principles of Natural Justice.  We immediately took up the issue with the IBA for the appropriate action on the subject.  Since, the IBA did not react; we have now sent a communication to the Chairman, Indian Banks Association quoting the guidelines issued by the Government of India on the subject.  A copy of the communication along with the enclosure is annexed.
2.         All our affiliates/members are requested to await further developments in the matter.

SHARING OF THE CONTENTS OF THE CONFIDENTIAL REPORT GOVERNMENT GUIDELINES
Please refer to our letter No. 1452/156/09 dated 23.07.2009.
2.         The Confederation had brought to your notice the contents of the verdict of the Hon’ble Supreme Court in the case of Dev Dutt  V/s Union of India wherein the Court held that the contents of the Annual Performance Appraisal Report should be shared with the officer concerned to enable him to assess his strengths and weaknesses and to improve upon it so that his career is not spoiled due to the confidential report written at his back.  The judgment was considered as a land mark one in the area of HRD concerns of the employers towards increasing the efficiency level of their workforce.
3.         It was our suggestion that a similar stand should be taken by the Managements of the Banks and the employees should have an opportunity of knowing their rating in the Confidential Report covering their annual performance which is to be the base for the purpose of promotions, etc., we are yet to hear from you. In the meanwhile, we have received a copy of the communication issued by the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Government of India No.21011/1/2005 Estt(A) (Pt/II) dated 14th May 2009, advising all the Public Sector Departments of a guideline framed by them for the purpose of dealing with the Annual Performance Appraisal Reports in tune with the import of the Judgment referred to above.  A copy is enclosed for your ready reference.
4.         We are happy that the Central Government has reacted to the judgment of the Supreme Court in a positive manner.  There is a need for issuance of a similar guidelines to the Banks as well since we are also part of the Public Sector undertakings and our service rules have been framed as per the Central Civil Service Rules and the personnel policies of the Banks with regard to the Promotion Policy, Transfer Policy, Disciplinary Proceedings etc., are akin to that of the rules applicable to the Government Servants. We therefore, request you to kindly take necessary steps to issue appropriate communication to all the member banks, keeping in view the spirit of the judgment of the Supreme Court as also to ensure that the best HR policies are observed in the banking industry as well.
