GRATUITY CEILING

Consequent upon enhancement of gratuity ceiling from Rs 3.5/- lacs to Rs. 10/- lacs (maximum) with effect from 01.01.2006 to Central Govt. employees as a part of 6th Pay Commission recommendations, by an administrative order, we took up the matter with the then Hon’ble Union Minister of State for Finance Shri. Pavan Kumar Bansal and the then Hon’ble Union Labour Minister Shri. Oscar Fernandes for enhancement of the Ceiling of Gratuity to Rs.10/- lacs through an amendment to Payment of Gratuity Act 1972 with effect from 01.01.2006. The undersigned along with Com. T.N.Goel, Jt. General Secretary, AIBOC met both the Ministers at Delhi and presented our case.  Both of them assured us to do the needful in the matter.  On account of declaration of Lok Sabha elections, the matter remained unresolved. 
After installation of the 15th Lok Sabha, once again we took up the matter with the ministry.  The undersigned met Hon’ble Union Labour and Employment Minister Shri. Mallilkarjuna Kharge at Bangalore and also the Hon’ble Union Minister of State for Labour and Employment Shri. Harish Rawat at Delhi along with Com. T.N.Goel and submitted our memorandum on the issue.  We also wrote a letter to the Hon’ble Finance Minister, Government of India.  We continued our vigorous follow-up with the ministries to impress upon them to move the bill in the winter session of the Parliament. We came to know that, there was a stiff opposition from the Private Sector employers and Corporates for enhancement of the gratuity ceiling.  Therefore, though Central Govt. was inclined to move the bill in the Parliament, it could not materialize.

We are glad to understand that the Central Govt. Cabinet has cleared the proposal of enhancement in gratuity ceiling to Rs.10/- lacs.  The bill after clearance from the law ministry will be placed before the Parliament by the Hon’ble Union Labour Minister for amendment to the Payment of Gratuity Act 1972.  The amendment will cover Private Sector employees and all those coming under Payment of Statutory Gratuity.  The maximum ceiling is proposed at Rs. 10/- lacs.  The date of effect may be decided by the Parliament.

Comrades, we have reached the present state of getting approval of the Cabinet through our continued and persistent follow-up with the concerned authorities.  We hope that the bill will be moved in the current budget session of the Parliament. We are following up the matter with the Govt.  We shall advise the members of further developments later.

TALKS WITH IBA UNFRUITFUL

One more round of discussions with IBA was held on  25/02/2010 at Mumbai to decide on distribution of wage load of 17.5% and other related factors. Four Officers’ Organizations went in a delegation to Shri K. Ramakrishnan CEO of IBA and submitted a common proposal on distribution of wage cost on various components of salary and allowances to the IBA, and requested for an early settlement. We also requested the IBA to draw the final settlement on pension and residual issues simultaneously, within the time frame fixed. He too expressed his concern on undue delay in arriving at final settlement and assured to expedite the matter.

Therefore the discussions with the core committee of the IBA commenced in a cordial atmosphere. The IBA core committee was represented by Shri. Jagadish Pai, B.B. Das, Rajeev Rishi, Unnikrishnan and Venugopalan.  After opening remarks from the Chairman of the Core Committee, we presented our response on the IBA’s proposal of 23/01/2010 and briefed on the basis of our proposal in distribution of the cost.

In our proposal, we have taken care to distribute the wage load in an equitable manner to all scales from JMGs-I to Scale VII. The HRA percentage retained as comparable to workman staff.  Additional cost on pension, House Rent Allowance etc. are calculated on a scientific basis.  The date of effect of pension to CPF optees is assumed as from retrospective date.  As more number of officers are stagnated at lower level of scales, a provision for additional two stagnation increments for officers in Scale-I to Scale IV was also suggested by us.  We ensured to avoid anomalous situation in pay scales, and incremental pattern as compared to the workmen scales etc.

Unfortunately, on none of our proposals, there was a positive response form the IBA and they stuck to their method of calculation of additional cost on HRA, pension and distribution of wage load of 17.5% on various scales.  It appeared that,  we have reached a dead end.  The discussions concluded without any fruitful result.

Thereafter, we shared the information with our small committee and other leaders and decided to seek appointment with the Chairman of IBA to present our views.  We also felt that, as avoidable delay is causing much frustration among the rank and file, we should keep them advised of factual position and be in readiness to take the issue to its logical end without loss of further time.  Accordingly, we communicated to our members the outcome of the discussions through SMS.    We have also communicated to the Chairman of the IBA our concern on the stalemate, and requested for his intervention and an appointment with him to explain our stand, at the earliest.  We propose to meet him in the next week.

Comrades, it appears that, IBA feels that it is their prerogative to decide on the pay scales and method of calculation of additional cost required for various components of salary and allowances out of 17.5% wage hike.  We can not accept their proposals as it has to be done through bilateral discussions to avoid heartburn and anomalous situation within officers’ cadre and also in comparison with workmen staff.  We have to take care of the aspirations of large number of our membership who have stagnated in their respective scales and their career progression.  We are confident of convincing IBA on the line of the distribution of wage cost, but things can not be taken for granted.  The time at our disposal is very short.  Hence, we request our membership, to be in readiness for organizational action, if the situation demands.  We shall advise further developments, after meeting the Chairman IBA. We also request our membership to bear with the situation as it is our intention to ensure justice to all category of officers in distribution of wage cost equitably, among all components of salary and allowances.

We have addressed a letter to the IBA against their decision to instruct  the Member Banks to adopt a decision to implement the New pension Scheme  for the new recruits /appointees w.e.f 01.04.2010  at a time when we are in the thick of  converting  the MoU signed on 27.11.2009 into a reality .

The letter is self–explicit and a copy is annexed herewith. We advise our affiliates to protest strongly if the Managements of the Banks come forth with an agenda in the Board Meeting for introduction of the New Pension Scheme before signing a regular settlement on Pension Issue. Such agenda should be got deferred by our representatives on the Boards.

IMPLEMENTATION OF NEW PENSION SCHEME

We have gone through the instructions given by you to the Member Banks on 04.03.2010, advising the Banks to seek the approval of the respective Bank Boards  on the following .

a.           Implementation of New Pension Scheme.
b.           Incorporating a clause in the appointment orders of the new recruits/appointees from 01.04.2010  intimating them that they would  be governed by the New Pension Scheme.

These instructions have been issued to the Member Banks at a time when the bipartite discussions/negotiations on finalization of Second Option on Pension settlement are still going on and the MoU signed by the Unions on 27.11.2009 is yet to be turned into a reality.

In fitness of things, the New Pension Scheme can be introduced only after signing the settlement on the pending second option on pension. Only after signing a full pledged settlement, the Bank Boards can adopt the New Pension Scheme . In this background it is not prudent on part of the IBA to instruct the Banks Boards to adopt a decision to implement the New Pension Scheme. We are not in agreement with your decision. We suggest that the instructions to the Member Banks may please be withdrawn\held in abeyance.

As the New Pension Scheme is going to be implemented from 01.04.2010 and the new recruits/appointees would be covered by the above scheme as agreed in MoU, it would be sufficient if the Banks are advised to incorporate the clause in the appointment letters to be issued to those who will be appointed in the service of the Banks from 01.04.2010 to the effect that they would be governed by the new pension scheme being introduced in the Banking Industry wef 01.04.2010 and they would not be covered by PF and  existing Pension Scheme.

We request you to send revised instructions to the Member Banks, keeping in view our above observations.

ENHANCEMENT OF GRATUITY FROM RS.3.50 LACS TO RS. 10.00 LACS

We learn from the print media, news paper columns that the proposed amendment to the payment of Gratuity Act 1972, enhancing the ceiling on gratuity from Rs.3.50 lacs to Rs. 10.00 lacs, has been cleared by the Union Cabinet Committee and the proposed amendments will be tabled in the Lokasabha for adoption. It is also reported that the bill will be passed in the current budget session of the parliament.

Your Ministry has put a big step forward bringing substantial relief and solace to millions and millions of labourers, workers, employees working in various sectors of the economy.  While we thank you profusely for bringing this long awaited legislation to reality, we will be highly obliged to you for giving effect to the amendment, from a retrospective date i.e., 01.01.2006, from which date enhanced gratuity was paid to the Central Government employees in the wake of the recommendations made by the VIth  Central Pay Commission. By giving effect to the amendment from 01.01.2006, the principles of equity and equality will be ensured.

Sir, we request and urge upon you to take note of our fore-quoted suggestion and your positive decision in this regard will be one of the most outstanding pro-labour measures in the contemporary history. The entire work force and labour class are waiting with baited breath for the passage of the bill in the Parliament and they all express their gratitude to you from the core of their hearts.

SILVER JUBLIEE CELEBERATIONS

The first meeting of the sub-committee on the Silver Jubilee Celebrations of AIBOC was held at Bangalore on 19th march 2010. Comrade K.S. Shetty President, Com. G.D. Nadaf General Secretary and the General Secretaries of Affiliates, Secretaries of State Committees participated. Members enthusiastically discussed about various activities to be undertaken during the celebrations period.

The celebrations are aimed to increase the visibility of AIBOC, enthuse and motivate the membership and also to utilize the opportunity to interact with the economically weaker sections of the society through social service activities. This will enable maximum participation of members in the celebrations. It will also provide an opportunity to understand the contributions of AIBOC in furthering the cause of Bank Officers by building a strong movement and to prepare bank officers’   to face the future challenges.

Following decisions were taken.
The Celebrations will take place at different levels, namely:
(a)            Confederation
(b)            Affiliates
(c)             State
(d)            District/Town/City
(e)            Sectoral Wings

CONFEDERATION LEVEL
(i)              Celebrations at all levels are to be held from April 2010 to 6th October 2010. For historical reasons the Inauguration will be held at Chennai in the 2nd week of April and valedictory will take place at New Delhi on Wednesday, the 6th October, 2010.
(ii)             Inauguration at Chennai :  As a curtain raiser, a National Seminar on “Growth, Development and Future Challenges to the Bank Officers’ Movement”  with focus on AIBOC to be organized. Senior leaders who are part of the movement for the last 25 years to be requested to participate. Massive publicity to the celebrations to be given. A symbolic inauguration of “Silver Jubilee Social Service Activities” will take place. Working committee meeting will be held on the same day.
(iii)           Social Service Activities: To make the celebrations more meaningful, it was decided to aim at reaching the remote parts of the country by holding social service activities in co-ordination with the state units.  Opportunity to be provided to all state units to conduct the activity.  The expenditure to the extent of Rs. 50,000/- per activity may be reimbursed by “AIBOC Social Welfare Trust”.  If possible the  State Units must also make efforts to raise voluntary contributions. The State Committes will have to submit a detailed plan of action including cost implications to the Welfare Trust for its approval. They have to submit the accounts after the events. 
(iv)           Silver Jubliee Publications: A Book on “History and Future Perspectives of AIBOC” to be co-authored by Com. Shantha Raju , Com. T. R. Bhat with Com. B.S. Ravindra as the Convenor will be published to commemorate the occasion. The committee can take inputs from the present and past senior leaders of AIBOC, the book will have to be released on 6th October, 2010, at New Delhi.
(v)            Special Commemorative Issue of “Common Bond” containing articles from the present and past leaders of AIBOC will be released on 6/10/2010.
(vi)           The valedictory programme will be held at New Delhi on 6th, October 2010. A Special Executive Committee Meeting can be held. An effort will be made to invite the Prime Minister/Finance Minister or Noble Laureate Dr. Amarthya Sen or some High Level dignitary of his stature. The Valediction can be preceded by a National Seminar on the “Future of the Public Sector Banks in India”.
(vii)         AIBOC to undertake postering, badge wearing, etc., to provide wide publicity for the Silver Jubilee.
(viii)        The Confederation and the Affiliates are requested to prominently print on their Letter Heads and Envelops annoucing the silver jubilee celebrations of AIBOC with a special logo designed for the occasion.

AFFILIATES’ LEVEL:
All Affiliates are requested to form their own Silver Jubilee Celebrations Committees which will design programmes suiting to the concerned organizations.
The  suggestions to the committees are:
(a)            Massive Silver Jubilee Meetings where the Affiliates have larger concentration of the membership. 
(b)            Minimum of one social service activity which will be funded by the Affiliate themselves.
(c)             Commemorative issues of House Journals to be published in October, 2010.
STATE LEVEL:
(i)              To form State Units, wherever it is not there.
(ii)            State Units to Organise District and Town/City Level Committees.
(iii)         Form AIBOC Women’s’ Wings wherever it is not formed.
(iv)            State Level Silver Jubilee Committee to be formed with State Secretaries as Convenors. All EC Members in the states under its jurisdiction will be ex-officio members. The Committee will also consist of District Secretaries and State Committee Members. The Committee will have to draw appropriate action plan to celebrate the Silver Jubilee.
(v)             The Committee has to plan at least one social service activity in co-ordination with “AIBOC Social Welfare Trust”.   Which will be conducted between April to September 2010.
(vi)           The Massive Special Silver Jubilee conventions are to be held in all state Head Quarters.  They can make efforts to raise a fund and also seek the central office support as per the Executive Committee directions.
(vii)        State level seminars can be organised with the participation of eminent speakers.  The subjects can be;
(a)  Consolidation of Bank Officers’ Movement
(b)  Present day Challenges to AIBOC
(c)   Future Shape and Size of Public Sector Banks in India
(d)  Implementation of ILO  convention Resolution No.87 & 98

DISTRICT LEVEL:
(i)       District Units to be reactivated which in turn have to activate city/town units.
(ii)     AIBOC  EC Members/State Committee members should visit district and interior places and hold special Silver Jubilee meetings. The recent developments regarding 2nd option on pension, wage revision etc will also enthuse members.

(iii)                             They can also plan for social service activities.

FINANCE:
(a)            One Social Service activity conducted by the State Unit will be supported by the Social Welfare Trust to the extent of Rs. 50,000/- only.
(b)            The state Units can seek financial support from Central Office with projected activity as per the EC guidelines.
(c)             Affiliates’ level activities have to be self financing.
(d)            AIBOC  Central Office has to bear the cost in respect of publications, inaugural and valedictory programmes.

2.        During the course of deliberations following suggestions were made;
(a)      All Vice Presidents to be made in charge for revival of state units.
(b)      “Conclave” of senior leaders to be held on 15th and 16th of May, 2010, to review the path traversed by the confederation during the past 25 years and to finalise road map for further journey.
(c)      A Compendium of important circulars issued by AIBOC to be prepared.
(d)      An office cum Guest House for AIBOC to be built/purchased at Mumbai.

3.        Comrades AIBOC Silver Jubilee Celebrations are a landmark in  bank Officers’ movement. During the last 25 years AIBOC has made valuable contributions towards Nation building. This is the time to celebrate struggles, successes and to rededicate ourselves to the cause of Bank Officers’ Movement.

4.        General Secretaries of Affiliates and State Secretaries are requested to form Silver Jubilee Celebration Committees by 10th of April 2010 under information to us.  State Committees are requested to finalise the Social Service Activities which they want to undertake and submit a detailed proposal to us immediately. Let us all join hands to make the event successful.
